Rollover accident on 59th ave and bell

I was in a rollover accident on 59th and bell in my green ek coupe anyone see it!? I would post pictures of I knew how to from my iPhone..

I'm careyfosho haha..

I was driving in the right lane down bell between 59th and 61st and a silver Toyota or nissan truck hit me trying to merge over to my lane not seeing me in his blind spot and he was trying to get to tail gaters.. He was drunk and was arrested from the scene immediately after completing a field sobriety test.. He had next to no damage done to his truck.. Ambulance took me to John c Lincoln on 3rd street and dunlap to the trauma department but did no ct scans, xrays or mris on me.. And I was released within the hour. The guy or his two passengers never left the vehicle the whole time I was at the accident scene.. I was not wearing my seat belt and yes I know I should have been.. But I was litterally 300 feet from my work which is where I had just left from.. My air bags never deployed! Anywho what I'm trying to get at is what should I do!? His insurance didn't want to take my statement until their insured could be released from jail to make his statement first. I talked to an attorney and it doesn't look like I'll be getting much back from this? Can anyone reccomende to a good attorney? I feel like I should e getting a second opinion on this case.

If I do that I should probably go thru a different attorney because the one I have spoken with was referred to me by my insurance agent so he probably would try and steer me away from suing them? Just wondering the benefits of suing my own INS company is... Still waiting on my police report it's not ready yet and I still have not made my statement to his insurance company... Got a cobalt for a rental FTL! Hahaha

its the thing to do. the other guy have good insurance? its not uncommon for people to sue there own insurance company. what are you supposed to do, settle for a loss if the other guy has shitty insurance? it wasnt your fault so why shouldnt you get payed out by both. his insurance is only gonna cover so much, including hospital bills wich is figured into your payout, and they are gonna try to pay you as little as possible. including on your car. you make sure to not settle for anything less than retail on your car, they will offer bare minimum. YOU were put into this hassle, pain, suffering, and im sure time off from work by there driver. all said and done you could end up with 4k in your pocket from the other insurance company for there driver in worst case scenorio, could of killed you? does that seem like enough for lost wages and suffering? then sue yours also. im telling you, the other company will try to lowball the fuck out of you on everything. you can have life long pain from your injuries. is settling for the minimum worth life long injuries? its not in my eyes

You can't sue both insurances, trust me, you can sue the guy for pain and suffering, hospital bills and for a new car. You can only double dip for both insurances to pay hospital bills. Example if you go to the hospital and use your health insurance card and have a deductable, then both insurance companies have to pay you back for co-pays so that is extra money in your pocket and the insurance company also has to pay back your health insurance in full.

So medical bills and replacing your car will come quick, but if you hire a lawyer to sue the guy for pain and suffering that could take a year or two. The insurance companies also have computer programs to list your injuries that will spit out an offer, so unless you broke something they will normally only offer maybe 1000 to 2000 for injuries especially if you were treated at the hospital and released the same day. If you have no follow up like physical therapy that also makes a weak case for you as well.
