View Full Version : Pulled over for too loud of an exhaust?

So I was pulled over last night around 10:30, officer said he pulled me over cuz my car was way to loud. He then tested my window tint. So i now have $331 in fines. However I feel that I was pulled over for driving a hinda civic on bell rd. I wasn't speeding, nor was i taking the rpm's above like 3k so i dont know how i was to loud. I believe this is because all the honda owners that hang out at ramiros and then go race up and down bell or where ever, that this cop just assumed i was one of them.

So my question is if I take a picture of the tint start removing it take a picture of it being removed and then a finished picture, will the judge drop the charge since i purchased the vehicle with the tint and exhaust on it? Or what could I do? Any info or personal experience with the same problems would be greatly appriciated.

Update:
Went to court today. Showed the judge a picture of my car with no tint on the front to windows. He dropped that ticket and told him I have been trying to get money to "fix" my exhaust and still have money to pay the fines today. He lowered the exhaust ticket from $201 to $110 and if I "fix" it by 2-19-08 and have proof I will get the $110 back. only paid $135 today! $25 in court fees.

im pretty sure you have to supply a reciept from a shop showing tint was changed to legal limit

Looks like a regular ticket, Never seen a fix it ticket. But it has a court date and all.

Will having it removed release me from having to pay the fines? If not Ill just remove it myself and pay the fines why pay a shop to remove it and pay the fines? However if i can pay a shop to remove it and not pay the fines that would be cheaper.

In the state of az it is illegal to modify your exhaust period, however it is rarely enforced.. Couldn't believe it when a dps officer pulled out his lil dot book and showed me

Thats not what is says here. Straight from Arizona State Legislature. However i relize Im kinda fucked on that one other than replacing it.

28-955. Mufflers; noise and air pollution prevention; emissions control devices; civil penalty; exception

A. A motor vehicle shall be equipped at all times with a muffler that is in good working order and that is in constant operation to prevent excessive or unusual noise.

B. A person shall not use a muffler cutout, bypass or similar device on a motor vehicle on a highway.

C. The engine and power mechanism of a motor vehicle shall be equipped and adjusted to prevent the escape of excessive fumes or smoke.

D. Beginning with motor vehicles and motor vehicle engines of the 1968 model year, motor vehicles and motor vehicle engines shall be equipped with emissions control devices that meet the standards established by the director of environmental quality.

E. A person who violates this section is subject to a civil penalty of at least one hundred dollars.

F. This section does not apply to an electrically powered motor vehicle.

these types of tickets usually you take down to your local pd and get them to sign off that you have indeed fixed the problems that were stated on the ticket. Then you go down to the courthouse and pay the 3 dollars that the ticket then becomes.

This happened to me a couple months ago it really depends on the judge I had to go back to court twice first time I did what your thinking an took pics of the exhaust off the car an they still gave me the ticket so I went back with a work order from a shop saying it has been removed. The second time it happened to me I sold the car before the court date but gl with your situation an you got lucky only 331 the judge tried to hit me up for 6 something

Never gotten a ticket, or a fixit ticket. :P

Though I did get pulled over once, and the cop tried to make me pop my hood.. I told him to get a warrant so he crawled onto the ground trying to look under my car at my exhaust. After like 5 minutes he pops back up and tells me my tint is illegal.. I ask him if he's got a tint gun, and he smirks and says.. "Yep, I'll go get it." my tint up front tested out at 7%. I got a ticket... I just payed that shit... fucking pimp tax.

More than likely if you get your shit fixed and prove to the judge that you got it fixed you'll be let off without any fines other than the court costs.

I tested at 6%. My exhaust isnt that loud at all really. No louder than anyother honda with a aftermarket.

welcome to driving a honda. unfortunately most people with hondas and fart cans drive and act like complete douche bags. the rest of us get profiled and pay the price for it.

modified exhaust are illegal. period. you were definately targeted for driving a honda. my 39 yr old brother drives an accord with a h swap and gets dicked with all the time, until he rolls down the window and they see some old guy driving.

basically they figure if your young and have a modded honda they know when they pull you over they will find plenty to cite you for. cops are redneck dick wads and dont like imports for the most part. and since you are young you are easily hassled, probably dont know your rights and they just like flexing there "power" over you. just smile and nod, its all part of the game.

its up to the judge, thats why he is the judge. if you are polite to the officer and made a real effort to fix the issue they will generally drop it. this is why i keep pictures of my cars when they were stock, so i can take them to court and say i fixed it :)

if you act like a respectable person you will get treated like one. if you act like a dick head know it all kid then they will bitch slap you with fines trying to set an example.

or you could be like me and get raped everytime you step in the court room merely because of your record :) last time i went to court i got thrown in jail for driving with an expired license. not suspended or anything, just expired. my bday is the day after xmas. i got a ticket first week of jan. you ever tried getting to mvd the week after xmas?

Well The only way i know that is from this here form, I never go to ramiros or have even been to any of the meets, so i would consider it harrasment and profiling. However i was polite and respectful to the officer.

i pulled over, out by ft. mcdowell casino and the fucker gave me a fix ticket / got it taken care of ( wink wink) , and thats it, i never even went to court, it was just like a warning i guess

So i keep hearing about these fix it tickets and I have never gotten one, nor seen one. do they look just the same as a normal ticket or are there no fines explained, please someone explain?

As I posted the legal statues above it says nothing about modifying your exhaust it just says it can be exsesively loud or unusual, doesnt give a decible limit or anything. Not being a dick just what i got from reading the statues. I relize that i drove a modded honda and it puts a target on my back, however it still seems like bull. But hey life isnt fair learned that at a young age.

Its states thats you have to below a db level for exhaust but i have yet to see a cop with a db reader so i would fight it and say that the exhaust was a after market replacement!!!

Damn, I'm sure this won't be the last.

I got pulled over a week ago down near 17th ave and Van Buren looking for a coffee shop that just re-opened. His reasoning? "You're driving a high profile car in an area like this, you shouldn't be. Don't you know these people will put a gun to your head, steal your car, shoot you and the girl you're with, and not think twice about it?"

I was blown away! I told him that was a ridiculous reason to pull me over, that I was pissed about it, his area isn't that ghetto, and shouldn't he be finding these people that will "put a gun to my head" instead?

But to your disadvantage, in your case he has a law he could use against you. Sorry man. :(

*note that my past experience with these type of tickets was in the state of florida. I got a ticket for window washer led lights. Got a ticket at 1:30 in the morning. Had 30 days to go down to any law enforcement office in the area and have them sign off that the citation item had infact been either put on a toggle switch or removed. Then off to pay a reduced fine of 3 dollars.

I'm so glad I'm a girl. I have been pulled over for tint once, having 10% and for not having license plate lights 5 times and have gotten only a warning every time. It won't be the last time they hassle you.

lol i had a judge tell the court room he didnt want to hear the harley arguement. basically admitting they just fuck with imports cause there imports.

harleys are owned by wealthy older professionals. dr's lawyers etc. imports are owned by kids. who you think they are going to hassle.

24 pages on my driving record- every citation was in a honda. NEVER been pulled over for no reason in ANYTHING else. my charger, dads truck, moms car nothing. all hondas

No its not illegal to modify your exhaust as long as it meets emission standards. Which basically means they have to prove that your car did not or would not pass emissions with that current exhaust.

I have never been "profiled" for driving a honda to my knowledge. If i was pulled over it was for breaking the law in one way or another. I've had cops try to write me tickets for bullshit I knew wasnt right though, and as soon as i called them out on it they let it go. So you should really read up on the laws so the next time you get pulled over you wont get suckered into a ticket.

you dont need documentation for scraping the tint. just scrape it, and take a picture of the car with todays paper on the windshield.

all teh documentation you need.

modified exhaust oh here we go again. sure its not federally illegal. this is why there are carb certified cat backs. however that is just to meet federal standards for emissions.

now when it comes to dot approval, or state and city laws theres a whole nother ball of wax. any city can write whatever law they want about your exhaust. further more the state can do the same thing. most states have laws on the books just in case they want to fuck with you. remember there are hundreds of thousands of lawyers whos only job is to dream up laws and bills to bust your balls just to collect the almighty dollar.

if you have money to spend fixing up your car, then you have money to spend on the tickets. they are not dumb. they know most people will just pay it and keep on rolling. collecting more tickets. its a business. it has nothing to do with your rights or them giving a shit about who you are.

they want your money. they know kids have excess money. they know kids arent well educated yet and will just pay it. fight it all you want, but the judge makes the final decission. i somehow doubt exhaust ticket appeals are going to make it in front of the supreme court.

My buddy got a ticket for sitting at a stop light in his Prelude for noise polution with his exhaust...

Just find someone with a radioshack Db meter and take a video of the meter next to the exhaust going full tilt and if you dont break any limit then you should have somewhat of an arguement.

This is the exact reason I just had the fart can removed from my prelude. It was so obnoxious, it even annoyed myself.

I hate the cops on bell. I got ticketed for no license plate light, on top of almost being hauled off to jail because the cops were some greenhorns who didnt know what the fuck they were talking about. STAY OFF OF bell on friday and saturday nights if you drive a honda unless you want to be harrassed by the import nazis. Good luck with your tickets.

maybe its just me, but i never got pulled over in anything other than my 1st honda the EF. but thats cause i was dumb and thought i was speed racer. since that time i had 8 hondas and all modified with the usual swap, nos, or i/h/e and wasnt harassed.

maybe its the area? ive always been in the east valley.

i got pulled over with a 3" exhaust, didnt take it over 3 grand, told me it was illegal to have an aftermarket exhaust, i was kinda a dick and said well if i got in an accident and they had to replace my exhaust thats an aftermarket one, then he just warned me ran my stuff and let me go.

Im not so much worried about paying the tickets its just the meer fact that I was pulled over for driving a honda on bell rd on a friday night. I will scrap the tint next weekend and try to get that ticket removed, as for the exhaust I know that its not really going to matter what i do. So I'll just pay that fine and move on

I was pulled over for running open DP, no winshield wipers(rain x ftw). I took pics of the stock axle back and wipers off my hardbody that were sitting on my garage floor. Took the pics to court(Phoenix) and it was dropped. Also pulled over for tint and no mudflaps and went to autozone. Bought some tint removal kit, cheap mud flaps. Took the receipts to court(Peoria) and it was dropped. Went straight back to autozone and returned the stuff.
